Application terms of use

Who provides the service

The data controller is ADN SOFT S.A.S. (“ADN Vortex”, “we”), a Colombian company with tax ID (NIT) 902094914-1, registered office at Calle 64 G # 90 A - 95, Bogotá D.C., Colombia and a second office at Calle 49 # 8-06, Soacha, Cundinamarca, Colombia.

Licence

ADN SOFT S.A.S. grants you a personal, limited, revocable, non-exclusive and non-transferable licence to install and use the applications on devices you control, solely for the purpose they were designed for.

The licence does not imply a sale of the software. We retain ownership of the application, its code, its trade marks and its design.

What you may not do

• Decompile, reverse engineer or attempt to obtain the source code, except to the extent the law imperatively allows.
• Resell, sublicense, rent or transfer the application to third parties.
• Remove or alter intellectual property notices.
• Use the application to monitor a person without a legal basis allowing it, or contrary to applicable labour or data protection rules.
• Interfere with the service, overload it or attempt to access other users' data.
• Use the application for unlawful activity.

Account and credentials

Access requires an account. You are responsible for the confidentiality of your credentials and for activity under your user. Tell us immediately if you suspect improper access.

If your account was created by your employer or by the company serving you, that organisation defines your permissions and may suspend it.

Connectivity, battery and data

Field applications use location and network continuously, which consumes battery and mobile data. Those costs are borne by whoever contracts the device's data plan.

The service depends on cellular coverage and satellite signal. We do not guarantee the availability of networks we do not operate.

Availability and changes

We aim to keep the service continuously available and publish scheduled maintenance windows in advance.

We may update, modify or discontinue features. If a discontinuation materially affects a client with an active contract, we will notify them with reasonable notice.

Content you upload

You retain ownership of the photographs, signatures and documents you upload. You grant us only the licence needed to host, process and display them within the service.

You are responsible for having the right to upload that content and for it not infringing third-party rights.

Limitation of liability

The applications are a tool supporting the operation. They do not replace prudent driving, compliance with traffic rules or each company's safety procedures.

To the extent the law allows, we are not liable for loss of profit, data loss attributable to third parties, or damages arising from use of the service beyond what the governing commercial contract provides.

Nothing in these terms excludes liability for wilful misconduct or gross negligence, nor the rights the law grants consumers.

Termination

You may stop using the application at any time by uninstalling it, and request deletion of your account through the corresponding page.

We may suspend access if we detect use contrary to these terms, giving notice unless there is imminent risk to the service or to third parties.

App stores

The applications are distributed through the App Store and Google Play. Apple and Google are not party to these terms and do not provide the service: they act as a distribution channel and their own terms also apply to the download.

Governing law

These terms are governed by Colombian law. Disputes will be submitted to the competent courts of Bogotá D.C., without prejudice to any consumer jurisdiction that may apply.
